The results of a comparative analysis carried out by the European
Commission show the level of responses member states have developed with regard
to fraud against the budget of the European Union.
The national Criminal Codes or equivalent bodies of legislation
all make provision for offences that can embrace both the Community's and the
member states' financial interests. Of these, obtaining by deception, forgery
and issuing forged documents and fraudulent conversion are the most important.
Some member states (the Netherlands, for example) list dozens of provisions to
be found in a great number of separate enactments that can be used against
fraudsters, depending on the form the fraud takes.
Most member states believe that the ordinary criminal offences are
adequately defined to protect the Community's financial interests. Assimilation
for enforcement purposes is implied in provisions creating offences and
penalties that are applicable in like manner: to Community and national
interests.
Even so, it is clear from some of the reports that the trend is
towards making fraud against the Community's financial interests an offence in
its own right. The trend has gathered momentum with the Convention on the
protection of the Community financial interests on which an agreement was reached
at Cannes and which was signed on 26 July 1995. Article 1(2) requires member
states to take the necessary and appropriate measures to transpose into their
criminal law the provisions of Article 1(1) (defining what constitutes fraud
against the Community's financial interests) so as to make the conduct
described therein a criminal offence. The purpose, as is clear from the
explanatory report, is that member states should make fraud either a specific
or an express offence or at least bring it within the general definition of the
offence of fraud.
There is a trend towards the development
of multidisciplinary control structures with responsibility for all areas of
fraud prevention and with wide-ranging investigative powers. In this way the
member states hope that more effective steps can be taken to combat organised
financial crime which is not necessarily confined to one particular sector.

The European Anti-fraud
Office (commonly known as OLAF, from French: Office
européen de lutte antifraude) is charged by the European Union with protecting the
financial interests of the European Union: Its tasks are to fight fraud affecting
the EU budget, as
well as corruption and any other irregular activity, including misconduct,
within the institutions of the European
Union, in an accountable,
transparent and cost-effective manner.
The
Anti-fraud Office achieves its mission by conducting, in full independence,
internal and external investigations. It also organises close and regular
co-operation between the competent authorities of the Member States in order to co-ordinate
their activities. OLAF supplies Member States with the necessary support and
technical know-how to help them in their anti-fraud activities. It contributes
to the design of the anti-fraud strategy of the European Union and takes the
necessary initiatives to strengthen the relevant legislation.
It is an
administrative investigative body. It has no judicial or disciplinary powers
and it cannot oblige national prosecutors to act.

OLAF is a General Service Directorate General of
the European Commission.
For its investigative and operational tasks OLAF works in full independence. In
a Special Report of July 2005 the European Court of Auditors concluded
that "the hybrid status of the Office, which has investigative autonomy
but reports to the Commission for its other duties, has not adversely affected
the independence of its investigative function. Being part of the Commission,
the Office has been able not only to benefit from substantial administrative
and logistical support, but also to take advantage of the anti-fraud
legislation that is available to Commission departments".[1]
OLAF has about 500 staff,[2] out
of which 160 are investigators. Many of them are lawyers rather than
accountants.[2]
The former German public
prosecutor Franz-Hermann Brüner was
appointed as Director-General for
a second five-year term on 14 February 2006 after agreement between the
European Commission, Parliament and Council,[3] but
died in January 2010. Director Nicholas Ilett is the acting Director
General. UKIP MEP and former
whistleblower Marta
Andreasen publicly expressed interest in the
position in April, and reiterated her view that OLAF should be separated from
the Commission.[2] The
post was assigned to Giovanni
Kessler, former Italian anti-fraud chief, in December 2010[4]
OLAF was created in 1999, after
strong pressure from the European Parliament.
Its predecessor UCLAF (Unité de coordination de lutte anti-fraude), an
anti-fraud unit dependent of the European Commission, had failed to convince in
the fight against irregularities within the European Institutions. The creation
of OLAF is one result of the debates about allegations of fraud and the conduct
of former European Commissioner Édith
Cresson which in the end led to the collective resignation of the Santer Commission.

can be found in the Special Report[5] of
the European Court of Auditors of
July 2005.
The European Parliament took
stock of the first six years of OLAF during a public hearing[6] in
July 2005.
The UK House
of Lords, in a report published in November 2006,[7] stated:
"On the basis of the evidence we have received we emphatically refute
claims that OLAF is too close to the Commission or that the Commission seeks to
divert and influence OLAF’s investigative activities". The House of
Lords concluded: "We are content with the extent of the investigations
which OLAF has undertaken."
Cigarette
companies' smuggling[edit]
Based on OLAF investigations and
under OLAF's assistance the European Commission and 10 Member States entered
into a lawsuit against three major international cigarette companies before US
courts. According to the allegations, the cigarette companies had used
smuggling as a channel of distribution. One of the companies later agreed on a
settlement which earned the European Union a compensation of around
1 billion Euros.
Eurostat[edit]
The most politically delicate OLAF
investigations were those into alleged wrongdoings in the EU statistical
office EUROSTAT. The case caused serious political
problems for the Prodi Commission in 2003. OLAF itself faced the accusation of
having started the investigations only after the press reported about the case
in 2002 and, especially, in May 2003. On top of that, on 8 July 2008 the
European Commission and OLAF were condemned to pay the legal costs plus 56,000
euros to Eurostat's director-general Mr. Franchet and its director Mr. Byk in
the judgement[8] of
case T-48/05 of the European Court of First Instance.

Мошенничество — хищение чужого имущества или приобретение права на
чужое имущество путем обмана илизлоупотребления доверием.
При этом под обманом понимается как
сознательное искажение истины (активный обман), так и умолчание об истине
(пассивный обман). В обоих случаях обманутая жертва сама передает свое
имущество мошеннику.
Изначально слово «мошенничество»
(по Соборному уложению) означало «обманное, ловкое (иногда внезапное) хищение
чужого имущества»[1].
Первое законодательное определение мошенничества, близкое к современному, было
дано в Указе Екатерины II от 3 апреля 1781 года «О разных
видах воровства и какие за них наказания чинит»: «Будь кто на торгу… из кармана
что вынет… или внезапно что отымет., или обманом или вымыслом продаст, или весом
обвесит, или мерою обмерит, или что подобное обманом или вымыслом себе ему не
принадлежащее, без воли и согласия того, чьё оно».
Согласно действующему уголовному законодательству РФ,
мошенничество можно определить как «совершенные с корыстной целью путем обмана
или злоупотребления доверием противоправные безвозмездное изъятие и (или)
обращение чужого имущества в пользу виновного или других лиц, причинившее ущерб
собственнику или иному владельцу этого имущества, либо совершенные теми же
способами противоправное и безвозмездное приобретение права на чужое имущество»[2].
Форма мошеннических обманов очень
разнообразна. Обман может совершаться в виде устного или письменного сообщения,
либо заключаться в совершении каких-либо действий: фальсификации предмета
сделки, применение шулерских приемов
приигре в карты или «в напёрсток», подмена отсчитанной
денежной суммы фальсифицированным предметом («куклой»), обвеси т.п.
Очень часто обман действием сочетается со словесным.
Злоупотребление доверием может
выступать в качестве самостоятельного способа мошенничества (например, при
получении кредита, который должник не намерен возвращать), но чаще сочетается с
обманом.[3]
Мошенники — своего рода элита
преступного мира. Это обычно люди, обладающие высоким интеллектом и
определенными познаниями в психологии. Они обладают умением вступать в контакт,
располагать к себе. Они также часто являются специалистами в экономике, информационных
технологиях и т. п.[4]
Мошенники часто используют
следующие психологические приемы:

предлагают совершить какую-либо сделку на условиях, которые
значительно выгоднее обычных;

заставляют жертву совершать какие-либо действия в спешке,
мотивируя это различным образом;
·
выдают себя за очень богатых, влиятельных и преуспевающих людей.

Существуют специализированные
организации по борьбе с мошенничеством. В ЕС этим
занимается Европейское бюро по борьбе
с мошенничеством, ЕББМ (OLAF, англ. European Anti-Fraud Office).
В МВД России
борьбу с мошенничеством в основном осуществляют работники отделов по
борьбе с экономическими преступлениями УВД. В некоторых ГУВД существуют и
специализированные отделы по борьбе с мошенничеством (также
см.Бюро специальных технических
мероприятий).
В ноябре 2013 года мэр Москвы Сергей Собянин предложил
квалифицировать по уголовной статье о мошенничестве неправомерное использование
чужой социальной карты москвича для
проезда в общественном транспорте[5].

Множество рассказов О. Генри (в частности сборник «Благородный жулик»)
рассказывает об американских мошенниках и их промысле.

произведением, описывающим жизнь мошенника в СССР,
является, безусловно, дилогия Ильфа и Петрова «12 стульев» и «Золотой телёнок», причём в ней можно
выделить подробное и достаточно квалифицированное описание самой специфичной
